The customer or sales partner agrees to indemnify and hold harmless Marchforth International KK (“Marchforth”) against any and all liability, claims, suits, losses, costs and legal fees caused by, arising out of, or resulting from any usage of a product sold by Unique Japan. The customer or sales partner shall also assume all responsibility for, and indemnify Marchforth against, all product liability claims wherever brought.

In the case in which an extraordinary Act(s) of God, such an earthquake or typhoon destroys and severely injures any or all of the sword inventory held at the Unique Japan office for clients in Tokyo or elsewhere, Unique Japan shall not be responsible in replacing or financially reimbursing such inventory to client(s). It is up to the client to obtain their own insurance and/or assume such risk for all inventory held by Unique Japan. This same Limitation of Liability extends towards a break-in to our office where items may be damaged or stolen. While Unique Japan has an alarm system installed at our studio office in Japan and does its best to secure and protect all goods in safe(s), Unique Japan cannot be liable for stolen swords and related goods if our office is maliciously targeted by criminals.

You may be subject to taxes and import duties, which are levied once a shipment reaches your country. Additional charges for customs clearance must be paid by you as we have no control over these charges and cannot predict what they may be. Customs policies vary from country to country.
